Terms of Service

1. Acceptance of these Terms

These Terms of Service (“Terms”) are a binding legal agreement between you and PinPal Technologies LLC, a California limited liability company (“PinPal,” “we,” “us,” or “our”). They govern your use of the PinPal mobile app (bundle identifier ai.pinpal.app), the pinpal.ai website, and any related services (collectively, the “Service”).

By creating an account, downloading the app, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

Please read Section 11 (Disclaimer of Warranties), Section 12 (Limitation of Liability), Section 13 (Indemnification), and Section 15 (Dispute Resolution; Arbitration; Class Action Waiver) carefully. They limit your rights, limit our liability, and require most disputes to be resolved by binding individual arbitration instead of in court.

2. Eligibility

You must be at least 18 years old to use the Service. By using it you represent that you are at least 18, have the legal capacity to enter this agreement, are not barred from using the Service under applicable law, and will use it only for lawful purposes. The Service is directed to adults managing their own personal wellness decisions. It is not intended for children, and it is not intended for clinicians to make treatment decisions for patients.

3. Your account

Most features require an account, created with Sign in with Apple or Google Sign-In. We do not offer email/password accounts. You are responsible for maintaining the security of your Apple or Google credentials and for all activity under your account, and you agree to notify us at [email protected] if you believe your account has been compromised. You may keep only one active account; creating multiple accounts to evade rate limits or restrictions violates these Terms.

4. License to use the Service

Subject to your compliance with these Terms, PinPal grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use the app on Apple devices you own or control, and to use the website, solely for your personal, non-commercial use. This license does not let you copy, modify, distribute, sell, or sublicense the Service; reverse-engineer or decompile the app (except where applicable law expressly permits); use the Service to build or benchmark a competing product without our written permission; remove proprietary notices; use automated means (scrapers, bots) without our consent; or place unreasonable load on our infrastructure. We retain all right, title, and interest in the Service.

5. Your content and conduct

You are responsible for the information you enter into the app — protocol names, dose values, reconstitution inputs, symptom check-ins, and notes (“User Content”). You retain ownership of your User Content. You grant us a worldwide, royalty-free, non-exclusive license to host, store, process, and display your User Content solely to operate and provide the Service to you; this license ends when you delete your content or account, except for backups and audit logs retained as described in the Privacy Policy.

You agree not to:

• Enter information you know to be false or misleading in a way that could harm yourself or others.
• Use the Service to harass, threaten, or defame any person.
• Use the Service to offer, promote, sell, or facilitate the purchase of any drug, research chemical, peptide, or controlled substance.
• Use the Service to engage in the unauthorized practice of medicine, pharmacy, or any other licensed healthcare profession.
• Upload malicious code, or probe, scan, or test the security of the Service except through an authorized responsible-disclosure channel.
• Attempt to circumvent rate limits, authentication, or access controls.
• Use the Service to collect or process personal information about anyone other than yourself, or in any way that violates applicable law.

We may remove User Content we reasonably determine violates these Terms or creates a safety or legal risk.

6. Medical disclaimer — please read carefully

The Service is not medical advice. PinPal is a consumer wellness tracking tool. It is not a medical device, is not cleared or approved by the U.S. Food and Drug Administration, and does not diagnose, treat, cure, or prevent any disease or condition.

PinPal is not a healthcare provider. Using the Service does not create a doctor-patient, pharmacist-patient, or any other clinical relationship. Before starting, stopping, combining, or changing any peptide, medication, supplement, or other aspect of your health, consult a qualified healthcare provider licensed in your jurisdiction. Do not delay or disregard professional medical advice because of anything in the Service.

The reconstitution calculator is informational only. It performs arithmetic on values you supply. It does not tell you what dose to take, how often, or whether anything is safe or appropriate for you, and its output may contain errors. You are solely responsible for verifying every calculation before acting on it.

AI-assisted guidance is educational only. The Service can return AI-generated informational responses, produced by third-party large language models. They are general educational reference — not personalized medical advice, not a diagnosis, not a treatment recommendation — and may be incomplete, inaccurate, or outdated. The peptide reference information in the app is likewise compiled from published literature for education only and is not a prescribing reference.

Individual results vary, and you are responsible for your own health decisions. Any information about expected effects, timelines, or outcomes is drawn from general sources and does not account for your individual biology, medications, or medical history. Any action you take based on the Service is your own responsibility.

Emergencies. The Service is not an emergency service. If you are experiencing a medical emergency, call 911 (in the United States) or your local emergency number immediately.

7. Research chemicals and peptide references

Some substances referenced in the Service — including peptides such as BPC-157, TB-500, CJC-1295, ipamorelin, sermorelin, GHK-Cu, and others — are not approved by the FDA for human use, and their sale and distribution for human use is restricted under U.S. law. PinPal does not sell, distribute, promote, recommend, endorse, or facilitate the purchase of any peptide, research chemical, or controlled substance; the Service contains no store, marketplace, or referral program. We do not represent that any peptide is safe, effective, legal, or appropriate for any person or purpose. You are solely responsible for complying with the laws of your jurisdiction regarding any substance you choose to track. Inclusion of a peptide in the app's reference database is not an endorsement or a representation of its legal status.

8. Subscriptions and payments

The Service offers an optional paid subscription, PinPal Pro. A free tier is available indefinitely; PinPal Pro unlocks additional features. PinPal Pro is an auto-renewing subscription offered at $1.99 per week or $34.99 per year (U.S. pricing; other regions are priced in local currency and shown in the app before purchase), with a one-week free trial for new subscribers.

Billing through Apple.Subscriptions are purchased and billed by Apple through the App Store's in-app purchase system. Payment is charged to your Apple ID at confirmation of purchase, or — if you start a free trial — at the end of the trial unless you cancel first.

Auto-renewal and free trial. Your subscription automatically renews at the end of each billing period at the then-current price unless you cancel at least 24 hours before the period ends. If you accept a free trial, it converts to a paid auto-renewing subscription at the end of the trial unless you cancel at least 24 hours beforehand; any unused portion of a trial is forfeited on purchase of a subscription.

Managing, canceling, and refunds.You can manage or cancel your subscription and turn off auto-renewal at any time in the iOS Settings app under your Apple ID → Subscriptions, or via Settings → Subscription in the app. Cancellation takes effect at the end of the current period. Because subscriptions are billed by Apple, refunds are handled by Apple under Apple's Media Services Terms; PinPal cannot directly issue refunds for in-app purchases.

Promotional offers and price changes.We may offer promotional codes or introductory pricing, generally limited to first-time subscribers and subject to the terms shown with the offer. We may change subscription pricing; where a change affects your subscription, Apple will notify you and, where required, seek your consent before it takes effect. Your purchase is also subject to Apple's Media Services Terms and the Apple Licensed Application End User License Agreement.

9. Intellectual property

All content, features, trademarks, logos, and functionality of the Service (other than your User Content) are owned by PinPal or its licensors and protected by intellectual property laws. “PinPal” and the PinPal logo are trademarks of PinPal Technologies LLC; you may not use them without our written permission. If you send us feedback or suggestions, you agree we may use them for any purpose without obligation to you.

10. Third-party services

The Service depends on third-party services, and your use of them is subject to their own terms: Apple HealthKit, Sign in with Apple, and the Apple App Store (Apple's agreements and App Store Review Guidelines); Google Sign-In (Google's terms); our backend host; and third-party AI providers that power the AI-assisted features. We also use third-party providers to host the pinpal.ai website. PinPal is not responsible for the acts, omissions, privacy practices, or terms of any third-party service.

11. Disclaimer of warranties

The Service is provided “as is” and “as available,” without warranty of any kind, express or implied. To the maximum extent permitted by law, PinPal disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement; any warranty that the Service will be uninterrupted, secure, or error-free; any warranty that the information, calculations, or AI responses in the Service are accurate, complete, or reliable; and any warranty of medical accuracy, therapeutic efficacy, or fitness for any health-related purpose. You use the Service entirely at your own risk. Some jurisdictions do not allow the exclusion of implied warranties, so some exclusions may not apply to you.

12. Limitation of liability

To the maximum extent permitted by law, PinPal and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including lost profits, lost data, or personal injury — arising out of or in connection with your use of (or inability to use) the Service, any content obtained from it, or any decision you make based on it, including any health outcome, whether or not PinPal was advised of the possibility of such damage.

PinPal's total aggregate liability for all claims arising out of or relating to the Service will not exceed the greater of (a) the amount you paid PinPal in the twelve months before the event giving rise to the liability, or (b) one hundred U.S. dollars ($100). These limitations are an essential basis of the agreement and survive termination. Some jurisdictions do not allow certain limitations, so some may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless PinPal and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms or any law, your violation of any third-party right, your User Content, or any claim relating to a health outcome you or anyone else allege was connected to your use of the Service or to any substance you chose to use, obtain, or handle.

14. Termination

You may terminate your account at any time via Settings → Delete Account in the app; deletion takes effect immediately in our production database, subject to the backup and audit-log schedule in the Privacy Policy. We may suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms, if your use poses a safety or legal risk, if required by law, or if we discontinue the Service. The sections covering the license you grant us, the medical disclaimer, research chemicals, intellectual property, warranty disclaimer, limitation of liability, indemnification, dispute resolution, and miscellaneous survive termination.

15. Dispute resolution; arbitration; class action waiver

Please read this section carefully — it affects your legal rights.

Governing law. These Terms and any dispute relating to them or the Service are governed by the laws of the State of California, without regard to conflict-of-laws principles.

Informal resolution first. Before filing any claim, you agree to try to resolve it informally by contacting [email protected] with a description of the claim and the relief you seek. We will attempt to resolve it within 60 days.

Binding arbitration. If we cannot resolve a claim informally, you and PinPal agree that any dispute arising out of or relating to these Terms or the Service (except as noted below) will be resolved by binding individual arbitration administered by JAMS under its applicable rules, held in Sacramento County, California (or by phone or video where permitted). Judgment on the award may be entered in any court of competent jurisdiction.

Class action waiver. You and PinPal agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class or representative proceeding. If this provision is found unenforceable, the entire binding-arbitration provision is null and void.

Exceptions and opt-out. Arbitration is not required for claims that may be brought in small-claims court (on an individual basis), for intellectual-property disputes, or for injunctive relief. You may opt out of the arbitration and class-waiver provisions by sending written notice to [email protected] within 30 days of first accepting these Terms, including your name, account email, and a clear statement that you wish to opt out. For any claim not subject to arbitration, you and PinPal agree to the exclusive jurisdiction of the state and federal courts in Sacramento County, California.

16. Miscellaneous

These Terms, together with the Privacy Policy, are the entire agreement between you and PinPal regarding the Service. If any provision is held unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may. We may give notices by email, in-app notification, or posting on the Service. PinPal is not liable for delays caused by events beyond its reasonable control. Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you, as required by the Apple Licensed Application End User License Agreement. We may update these Terms; material changes will be announced by in-app banner and email at least 30 days before they take effect, and continued use after a change becomes effective constitutes acceptance.
